Retake the Oath

On Law Day, May 1st, we invite you to retake your Attorney's Oath. We each took this pledge upon admission to the bar. The oath is the cornerstone of our profession, and it represents our promise to support the Constitution of the United States. It encompasses a duty to defend the Constitution, protect constitutional rights, ensure due process, and oppose laws or actions that undermine it. By retaking the oath, you reiterate your role as a guardian of the independence of the judiciary and the rule of law.

  • Alabama: The official source for the Alabama Attorney Oath of Office is the Alabama State Bar 13. According to the Alabama Rules for Admission to the Bar, every attorney must take an oath before being permitted to practice 1. The exact text of the oath is: "I, ___________________________, do solemnly swear (or affirm) that I will demean myself as an attorney, according to the best of my learning and ability, and with all good fidelity, as well to the court as to the client; that I will use no falsehood or delay any person's cause for lucre or malice, and that I will support the constitution of the State of Alabama and of the United States, so long as I continue a citizen thereof, so help me God" 13.

  • Alaska: The Alaska Bar Association is the official source for information regarding bar admissions 14. Alaska Bar Rule 5, Section 3 outlines the requirements for admission, including the attorney's oath 14. The oath is administered before any state or federal judicial officer and reads: "I do swear or affirm: I will support the Constitution of the United States and the Constitution of the State of Alaska;...source 14.   • Arizona: The State Bar of Arizona provides information on attorney admissions 16. Rule 41 of the Arizona Rules of the Supreme Court outlines the duties and obligations of members, including the Oath of Admission 16. The official text of the oath to be taken before a Notary or other authorized administering officer is: "I, (licensee name) solemnly swear (or affirm) that I will support the Constitution of the United States and the Constitution of the State of California, and that I will faithfully discharge the duties of an attorney and counselor at law to the best of my knowledge and ability. As an officer of the court, I will strive to conduct myself at all times with dignity, courtesy and integrity" 18.

  • Colorado: The Colorado Supreme Court outlines the Attorney Oath of Admission 19. The oath is administered to all individuals at the time of their swearing-in and admission to the practice of law in Colorado 20. The text is: "I DO SOLEMNLY SWEAR (OR AFFIRM) that: I will support the Constitution of the United States and the Constitution of the State of Colorado; I...source as the case may be, that you will do nothing dishonest, and will...source States and the Constitution of the State of Delaware; that I will behave myself in the office of an attorney within the Court according to the best of my learning and ability and with all good fidelity, as well to the Court as to the client; that I will use no falsehood, nor delay any person's cause through lucre and malice” 3.

  • Florida: The Oath of Admission to The Florida Bar is provided by the Florida Bar 23. The text of the oath is: "I do solemnly swear: I will support the Constitution of the United States and the Constitution of the State of Florida; I will maintain the respect due to courts of justice and judicial officers; I will not counsel or maintain any suit or proceedings which shall appear to me to be unjust, nor any defense except such as I believe to be honestly debatable under the law of the land; I will employ for the purpose of maintaining the causes confided to me such means only as are consistent with truth and honor, and will never seek to mislead the judge or jury by any artifice or false statement of fact or law; I will maintain the confidence and preserve inviolate the secrets of my clients, and will accept no compensation in connection with their business except from them or with their knowledge and approval; To opposing parties and their counsel, I pledge fairness, integrity, and civility, not only in court, but also in all written and oral communications; I will abstain from all offensive personality and advance no fact prejudicial to the honor or reputation of a party or witness, unless required by the justice of the cause with which I am charged; I will never reject, from any consideration personal to myself, the cause of the defenseless or oppressed, or delay anyone’s cause for lucre or malice. So help me God" 23. The inclusion of a civility pledge is a notable aspect of this oath 24.

  • Georgia: The oath for admission to practice in the Georgia Supreme Court is outlined in the Georgia Rules of the Supreme Court, Rule 4 25.   • Hawaii: Rule 1.5 of the Hawaii Rules of the Supreme Court specifies the oath of office to be taken by each attorney 27. The oath reads: "I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States and the Constitution and laws of the State...source Bar 29. The text is: “I DO SOLEMNLY SWEAR THAT: (I do Solemnly Affirm That:) I will support the Constitution of the United States...source and that I will faithfully discharge the duties of the office of attorney and counselor at law to the best of my ability" 4.

  • Indiana: Rule 22 of the Indiana Rules for Admission to the Bar and the Discipline of Attorneys outlines the Oath of Attorneys 32. The oath reads: “I do solemnly swear or affirm that: I will support the Constitution of the United States and the Constitution of the State of Indiana; I will maintain the respect due to courts of justice and judicial officers; I will not counsel or maintain any action, proceeding, or defense which shall appear to me to be unjust, but this obligation shall not prevent me from defending a person charged with crime in any case; I will employ for the purpose of maintaining the causes confided to me, such means only as are consistent with truth, and never seek to mislead the court or jury by any artifice or false statement of fact or law; I will maintain the confidence and preserve inviolate the secrets of my client at every peril to myself; I will abstain from offensive personality and advance no fact prejudicial to the honor or reputation of a party or witness, unless required by the justice of the cause with which I am...source help me God” 32.

  • Iowa: Iowa Code § 602.10110 mandates that all persons admitted to the bar take an oath or affirmation 34.   • Louisiana: The Lawyer's Oath in Louisiana is provided by the Louisiana State Bar Association 39. The oath is extensive and includes commitments to supporting the constitutions, maintaining respect for courts, avoiding unjust suits, employing honorable means, maintaining client confidentiality, pledging fairness and civility to opposing counsel, abstaining from offensive personality, and never rejecting the cause of the defenseless or oppressed 39.

  • Maine: Title 4, § 806 of the Maine Statutes outlines the Attorney's oath 41. The oath is: "You solemnly swear that you will do no falsehood nor consent to the doing of any in court, and that if you know of an intention to commit any, you will give knowledge thereof to the justices of the court or some of them that it may be prevented; you will not wittingly or willingly promote or sue any false, groundless or unlawful suit nor give aid or...source So help you God" 41. Notably, this oath includes an affirmative duty to inform the court of any intention to commit falsehood 42.

  • Maryland: § 10-212 of the Business Occupations and Professions Article of the Maryland Code prescribes the Maryland Attorney's Oath 43. The oath reads: “I do solemnly (swear)(affirm) that I will at all times demean myself fairly and...source contrary notwithstanding” 43.

  • Massachusetts: Chapter 221, Section 38 of the Massachusetts General Laws outlines the oath of office for attorneys 45. The oath is: "I (repeat the name) solemnly swear that I will do no falsehood, nor consent to the doing of...source my clients. So help me God" 45. Massachusetts claims to have one of the oldest attorney oaths in the country 48.

  • Michigan: The Michigan Lawyer's Oath is provided by the State Bar of Michigan 49. The text is: "I do solemnly swear (or affirm): I will support the Constitution of the United States and the Constitution of the State of Michigan; I will maintain the respect due to courts of justice and judicial officers; I will not counsel or maintain any suit or proceeding which shall appear to me to be unjust, nor any defense except such as I believe to be honestly debatable under the law of the land; I will employ for the purpose of maintaining the causes confided to me such means only as are consistent with truth and honor, and will never seek to mislead the judge or jury by any artifice or false statement of fact or law; I will maintain the confidence and preserve inviolate the secrets of my client, and will accept no compensation in connection with my client's business except with my client's knowledge and approval; I will abstain from all offensive personality, and advance no fact prejudicial to the honor or reputation of a party or witness, unless required by the justice of the cause with which I am charged; I will never reject, from any consideration personal to myself, the cause of the defenseless or oppressed, or delay any cause for lucre or malice; I will in all other respects conduct myself personally and professionally in conformity with the high standards of conduct imposed upon members of the bar as conditions for the privilege to practice law in this State" 49.   • Missouri: Rule 8.15 of the Missouri Supreme Court Rules outlines the Oath or Affirmation for attorneys 57. The oath is: "I do solemnly swear/affirm that I will support the Constitution of the United States and...source oath 7. The oath is: "You do solemnly swear that you will support the Constitution of the United States, and the Constitution of this state, and that you will faithfully discharge the duties of an attorney and counselor, according to the best of your ability" 7. The Nebraska Supreme Court Rules also specify the oath 63.

  • Nevada: Rule 73 of the Nevada Supreme Court Rules outlines the Attorney's oath 64. The oath is: "I DO SOLEMNLY SWEAR, OR AFFIRM, THAT: I will support the Constitution and government of...source best of my knowledge and ability" 64.

  • New Hampshire: New Hampshire Revised Statutes § 311:6 provides the text of the attorney oath 66. The oath is: "You solemnly swear or affirm that you will do no falsehood, nor consent that any be done...source and penalty of perjury.*" 66.

  • New Jersey: The New Jersey Attorney's Oath is found on the Roll of Attorneys form provided by the New Jersey Board of Bar Examiners 45. The oath reads: "I, , do solemnly swear (or affirm) that I will support the Constitution of the United...source justly, to the best of my ability" 45.

  • New Mexico: Rule 15-208 of the New Mexico Rules Governing Admission to the Bar outlines the oath or affirmation 69. The oath is: "I, __________________, do solemnly swear or affirm: I will support the Constitution of the United States and...source unjust, nor any defense except such as I believe to be honestly debatable under the law of the land; I will employ for the purpose of maintaining the causes confided to me such means only as are consistent with truth and honor, and will never seek to mislead the judge or jury by any artifice or false statement of fact or law; I will maintain the confidence and preserve inviolate the secrets of my clients, and will accept no compensation in connection with their business except from them or with their knowledge and approval; I will maintain civility at all times, abstain from all offensive personality, and advance no fact prejudicial to the honor or reputation of a party or witness unless required by the justice of the cause with which I am charged; I will never reject from any consideration personal to myself the cause of the defenseless or oppressed, or delay any person's cause for lucre or malice" 69.

  • New York: Judiciary Law § 466 mandates that each person admitted to practice law in New York take the constitutional oath of office 70. The specific text of the constitutional oath is: "I do solemnly swear (or affirm) that I will support the constitution of the United States, and the constitution of the State of New York, and that I will faithfully discharge the duties of the office of ______, according to the best of my ability" 72. Additionally, the Appellate Division, Fourth Judicial Department, provides an Oath of Office for Bar Admission Ceremonies, which includes supporting the US and New York Constitutions and faithfully discharging the duties of an attorney and counselor at law 73.

  • North Carolina: The North Carolina State Bar provides the Oath of Office for attorneys 75. There are versions for both swearing and affirming. The swearing version includes pledges to support the US Constitution, bear true allegiance to North Carolina, and truly and honestly demean oneself in the practice of law 75. The affirming version replaces "swear" and "so help me God" with "affirm" 75.

  • North Dakota: North Dakota Century Code § 27-11-20 requires each applicant for admission to take the oath prescribed in section 4 of article XI of the Constitution of North Dakota, along with any additional oath required by the Supreme Court 76. The constitutional oath is: "I do solemnly swear (or affirm as the case may be) that I will support the Constitution of the United States and the Constitution of the State of North Dakota; and that I will faithfully discharge the duties of the office of _________ according to the best of my ability, so help me God" 77. The specific additional oath required by the Supreme Court is not detailed in the provided snippets. The US District Court for the District of North Dakota also has its own Oath of Admission 31.

The US District Court for the Northern District of Oklahoma also has an Attorney Admission Oath 81.

  • Oregon: ORS 9.250 specifies that applicants for admission must execute a written oath 82. The oath states that in the practice of law, the applicant will support the US and Oregon Constitutions and be of faithful and honest demeanor in office 82. The Oregon State Bar provides a specific oath form that includes a pledge of fairness, integrity, and civility to the court and opposing counsel 82.

  • Pennsylvania: Title 42 § 2522 of the Pennsylvania Consolidated Statutes outlines the oath of office for attorneys 85. The oath is: "I do solemnly swear (or affirm) that I will support, obey and defend the Constitution of the United States and the Constitution of this Commonwealth and that I will discharge the duties of my office with fidelity, as well to the court as to the client, that I will use no falsehood, nor delay the cause of any person for lucre or malice" 85.

  • Rhode Island: Rule 8 of the Rhode Island Supreme Court Rules specifies the oath taken by attorneys 88.   • Vermont: Rule 20(e)(2) of the Vermont Rules of Admission to the Bar outlines the required Oaths of Admission 9. There are three oaths: one in accordance with 12 V.S.A. §§ 5812 and 5851, one in accordance with Chapter II, Section 56 of the Vermont Constitution, and an additional oath to be true and faithful to the United States 9.
